This is even more true for a compulsory liquidation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can just as well be legal deadlines that cannot be reduced as processing times (therefore more practical and technical).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The<strong> receivership: how long <\/strong>?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When we are interested in <strong>receivership and its duration,<\/strong> several steps must be taken into account.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Estimation of the date of suspension of payments<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">At the time of the opening of the <a href=\"https:\/\/www.phenix-expertise.com\/en\/fr\/services\/redressement-judiciaire\/\">legal redress<\/a>, like judicial liquidation, it is necessary to determine when the suspension of payments occurred.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Most often the <strong>date of cessation of payments <\/strong>retained is that of <strong>opening judgment<\/strong>. The judge may, however, consider that the date is prior to the pronouncement of the opening of the decision and then has the possibility of tracing the suspension of payments back to <strong>18 months <\/strong>before.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The r<strong>judicial relief: its duration<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, when a judicial reorganization procedure is opened, a period known as the \u201cobservation period\u201d begins. Its duration is <strong>6 months<\/strong> but it can however be prolonged to reach<strong> 18 months<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During this observation period, the receiver can take stock of the company&#039;s financial situation in order to determine to what extent or not it can rectify its situation. This period ends with the adoption of the recovery plan or the closure of the recovery if it is realized that it is impossible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Generally creditors have<strong> 2 months<\/strong> to declare themselves. This <strong>however, the deadline is doubled for residents outside mainland France<\/strong> or abroad. There are also specific time limits specific to certain types of receivables and security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, when a recovery plan is adopted, it can last up to<strong> 10 years<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if we take the maximum estimates, a <strong>receivership can last 11 years and 6 months<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How long a <strong>hard liquidation<\/strong>she?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After looking at the duration of a bankruptcy reorganization, we will now study the specific case of liquidation.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What is the deadline for opening a judicial liquidation?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The procedure of <a href=\"https:\/\/www.phenix-expertise.com\/en\/fr\/services\/liquidation-judiciaire\/\">judicial liquidation<\/a> can be acted upon immediately if the court finds that recovery is impossible. We can also try to reorganize the business and during the procedure realize that it is impossible to do so, in which case the reorganization becomes a judicial liquidation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As soon as the judgment of judicial liquidation has been recorded, the association, the company or the person must immediately cease its activity. The court may, however, grant an exemption from<strong> 3 months<\/strong> which can be extended once (either for <strong>6 months<\/strong> maximum).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The <strong>judicial liquidation: a period <\/strong>very variable<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You should know that judicial liquidation does not have a legal deadline. Also the <strong>duration of a judicial liquidation is very changeable<\/strong> ; several elements can be taken into account to estimate its duration:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the number of employees<\/li><li>heritage for sale<\/li><li>litigation<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">When does the compulsory liquidation end?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court pronounces the closure of the judicial liquidation when the continuation of operations is rendered impossible. This impossibility may vary depending on several factors:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>insufficient assets<\/li><li>when the liquidator has sufficient sums to pay off the creditors.<\/li><li>in the event that difficulties arise in realizing the residual asset and that the continuation of the procedure is of little interest.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Also note that the closure of the compulsory simplified judicial liquidation is pronounced at the latest within the <strong>6 months<\/strong> after the opening of the proceedings.
